Terms of Service
AnchorPoint Media LLC · Effective Date: July 28, 2026
By paying an invoice from AnchorPoint Media LLC, you ("Client") agree to the following terms:
1
Scope of Work
AnchorPoint Media will build your website based on what is agreed upon in writing before the project begins. Not included unless explicitly discussed and agreed upon in writing: photography/video production, e-commerce functionality, ongoing marketing or SEO services, copywriting, or third-party software licensing fees. Any work outside the agreed scope will be quoted and billed separately before work begins.
2
Payment
- —A 50% deposit is required before work begins. The remaining 50% is due upon approval of the final build, whether by written approval from the Client or by the automatic approval described in Section 3. The site will not be published until the balance is paid in full.
- —The site will not be published until paid in full.
- —Payments are non-refundable once work has started.
- —If a project is abandoned by the Client for more than 30 days with no communication, the deposit is forfeited and the project is considered cancelled.
- —Post-launch updates outside of the hosting plan are billed at $75/hour.
3
Revisions
- —Each project includes 2 rounds of revisions during the build phase.
- —A revision round is defined as one consolidated set of feedback submitted at one time — not ongoing or piecemeal requests.
- —Revision rounds must be used before the site goes live. Requests submitted after each round is addressed count toward the next round.
- —Once both rounds are used, additional revisions during the build phase are billed at $75/hour.
- —After launch, all changes outside the hosting plan are billed at $75/hour.
- —Client feedback must be submitted within 5 business days of a preview or revision being delivered. If no feedback is received within that window, the work is considered approved as delivered and the revision round is closed. Changes requested after that point count as a new revision round and are billed at $75/hour if both included rounds have been used.
4
Client Responsibilities
- —Client agrees to provide all content (text, images, logos, etc.) before work begins or within a timeline agreed upon in writing.
- —Client agrees to provide login access to their domain registrar, along with any existing hosting, email, or analytics accounts, at project kickoff. AnchorPoint Media cannot connect a domain or publish a site without this access.
- —Client agrees to respond to feedback requests within 5 business days.
- —Client is solely responsible for ensuring they have legal rights to all content provided.
- —Delays caused by late content, feedback, or account access may impact the project timeline and AnchorPoint Media is not responsible for resulting delays.
5
Domain & Hosting
- —AnchorPoint Media can manage domain registration and hosting on the Client's behalf, or the Client may manage these independently.
- —Hosting and platform fees are billed monthly or annually as agreed.
- —Failure to pay hosting fees may result in the site being taken offline. AnchorPoint Media is not responsible for data loss resulting from non-payment.
- —A monthly hosting and maintenance plan is available at the rate quoted at time of project completion, which includes hosting and up to 30 minutes of minor content updates per month (text changes, photo swaps, etc.).
- —Updates beyond the included 30 minutes are billed at $75/hour.
- —The maintenance plan may be cancelled with 30 days written notice.
- —AnchorPoint Media reserves the right to adjust hosting pricing with 30 days written notice.
6
Platforms
- —Websites may be built on third-party platforms including but not limited to Base44, Framer, Wix, or similar tools.
- —AnchorPoint Media is not responsible for outages, downtime, policy changes, or discontinuation of third-party platforms.
- —AnchorPoint Media will make reasonable efforts to notify the Client of any platform changes that affect their site.
7
Cancellation
- —Either party may cancel the project before completion with written notice.
- —If work has started, Client agrees to pay for all work completed up to the date of cancellation.
- —The deposit is non-refundable in all cases once work has begun.
- —If Client is unresponsive for more than 10 consecutive business days during an active build, the project is placed on hold and the balance for work completed to date becomes due. Resuming a project on hold requires a $250 restart fee and is subject to current availability.
- —AnchorPoint Media reserves the right to cancel a project if Client is unresponsive for more than 30 consecutive days, with deposit forfeited.
8
Ownership
- —Once the project is paid in full, the Client owns the website content and design as delivered.
- —AnchorPoint Media retains the right to display the project in its portfolio and marketing materials unless the Client requests otherwise in writing.
- —Any proprietary templates, systems, frameworks, code libraries, or tools developed or used by AnchorPoint Media remain the intellectual property of AnchorPoint Media.
9
Limitation of Liability
- —AnchorPoint Media is not responsible for lost revenue, lost business opportunities, or any indirect or consequential damages arising from the website or its performance.
- —Total liability in any case is limited to the amount paid by the Client for the specific project in question.
- —AnchorPoint Media makes no guarantees regarding search engine rankings, traffic, or business results.
10
Hosting & Subscription Continuity
- —The client's website is currently hosted on the Base44 platform. Hosting fees are covered by AnchorPoint Media LLC as part of the agreed service.
- —In the event that AnchorPoint Media LLC ceases operations, dissolves, or is otherwise unable to continue providing services, the Client will be responsible for assuming and paying any ongoing Base44 hosting or subscription fees required to keep their website active.
- —AnchorPoint Media LLC will make reasonable efforts to notify the Client in advance of any such transition.
- —This clause survives termination of the agreement.
11
General
- —Client is solely responsible for all content published on the website and its lawful use.
- —These terms are governed by the laws of the State of Maine.
- —These terms represent the full agreement between both parties and supersede any prior verbal or written discussions.
- —AnchorPoint Media reserves the right to update these terms with reasonable notice.
